San Jose, California (October 31, 2019) – The 54-year-old man who died in a two-vehicle collision early Saturday morning in San Jose has been identified as Gilberto Delacruz Padilla, according to the California Highway Patrol.

The fatal accident occurred at around 3:35 a.m., October 26, on Highway 101 near McKee Road

The CHP said Padilla was driving a Chevrolet Cobalt northbound on Highway 101 when, for an unknown reason, he swerved left and cut across several lanes.

The Cobalt was struck on its rear by a 1990s Mercedes SUV that was also traveling northbound on Highway 101.

The Mercedes continued and slammed into the guard rail while the Cobalt traveled across all the lanes and stalled on the shoulder of the highway.

Padilla suffered life-threatening injuries and was rushed to a nearby hospital. Sadly, he succumbed to his injuries while undergoing treatment.

A 47-year-old man from San Jose who was driving the SUV driver sustained minor injuries in the crash.

The authorities temporarily closed one lane of the highway as the crews cleared the scene.

No additional information regarding the crash was provided. The crash is under investigation.

Wrongful death and personal injury attorney Arin Khodaverdian, President and Managing Partner of Alpine Law Group, urges accidents victims and their families to immediately seek legal assistance. “Those who are affected by tragedy have rights, but they must act quickly in order to preserve those rights to the full extent of the law. Often, swift action by an experienced attorney is imperative in order to preserve evidence, interview witnesses and immediately begin pursuing any and all responsible parties.”

While Mr. Khodaverdian does not represent any of the parties involved in this incident, he has recovered over $100 million for thousands of injury victims and their families. “In one case, we were able to recover a 7-figure settlement within 11 business days of being hired by the family of a victim killed by a negligent driver. While this result is atypical and does not predict future outcomes, justice in this case help bring about closure and a swift sense of justice for the family.”
