Arizona Immigration Law Text:2010 SB1070 Fallout – Lindsay Graham, a republican Senator from South Carolina recently refused to support a climate bill that he has been working on with Joe Lieberman and John Kerry because he feels that immigration legislation has been pushed to the forefront before the issue was ready to be taken on. He recently stated that the new Arizona immigration law is unconstitutional and that “it doesn’t represent the best way forward.”

The new law, which was signed by the Governor of Arizona on Friday, requires that all immigrants carry documentation verifying their immigration status. It also stipulates that police officers have the authority to ask to see the information from any individual that is deemed “suspicious” or when there is “reasonable suspicion” that the person may not be legally in the country.

Protesters have taken a stand against the law, claiming that the vague text allows too much to interpretation, and have said that they believe that the bill will undoubtedly lead to further racial profiling as a result. Even Meghan McCain, daughter of Arizona Senator John McCain, recently commented in opposition to the bill, saying that the problem needs to be fixed at the source (the border), rather than forcing every immigrant to carry their papers with them in case they are asked to present them to law enforcement.
President Barack Obama recently called the law “misguided”, and has asked that the Justice Department take a look at the bill to determine the implications. Some believe that the bill encroaches on federal authority to regulate immigration, and may even violate constitutional rights in the process. Arizona’s Governor responded by saying that the bill is the right move because the federal government has been unable to secure the border thus far, and that the state of Arizona loses billions of dollars every year to illegal immigrants.

  1. Interesting, the President calls this bill ,’misguided’. He was asked five times by Gov. Brewer for assistance in protecting the border and her constituents. He never responded to her. The federal governments primary job is to protect it’s citizens. I firmly believe Gov. Brewer did the right thing to protect her state. SHAME on you Pres. Obama for failing once again to do your job. Who are you protecting?

    • The state of Arizona and its citizens have the right to do this. There is no federal authority which excludes a state from protecting its own borders. Protection of borders is a responsibility assigned by the states to the federal government — it is not an exclusive authority. The fact of the matter is this — any state has the right to take the federal government’s authority to protect its borders wheneever it wishes…. It is the federal government’s sole responsbility to protect the rights of the states and their citizens and the basic rights of life, liberty, and property (pursuit of happiness). These are not citizens of the US; if we choose to treat them as equals under our laws; that is a kindness that we do as a society; not some false requirement of a federal government and President that seems to feel that it has greater duties to the world at large than it does to its own citizens.

The illeagals want to come over here commit crimes do bad things and all that happens is they get deported. Oh yea last I checked it was illegal for an AMERICAN citizen to go around the state or country without proper identification.

    • think about this for a second….are you not at all concerned about the whole idea of carrying papers and always having to be able to prove your citizenship?That brings up some shades of some other regimes that weren’t necessarily helpful to democracy. next thing you know they will decide that the whole star of david patches are a dandy idea. maybe they will make all us folks with hispanic roots wear sobrero pin’s or something…

      • But, if I as a non-hispanic person have to carry a Gov’t-issued ID (driver’s license/ID, green card,etc), or present a SocSec card to obtain a job,,,and if I’m stopped for speeding or other offense I need to present it.
        This law as presented, specifically strengthens AGAINST profiling. And bars law-enforcement from stopping a vehicle/person based solely on appearance.
        The law appears to echo Immigration policy at the federal level. (secure borders).
        And the Constitution allows for state sovereignty over federal law.(10th amendment, 1791)

      • So have you ever traveled abroad? Every country I have been to: Germany, Italy, Netherlands, Mexico, Thailand, Japan, Dominican Republic, Canada and more they all ask for visitors to have their paperwork. Why is it wrong for the United States to ask people who are here to show that they have a right to be here? I don’t see how that fits into the draconian category.

  2. It takes integrity and real guts to do what many men would not do. Thank you for enforcing and upholding our laws. The road will probably get a lot tougher unless the wet noodle conservatives in this country start to stand up!

    This illustrates a common error by those who oppose the law. All legal immigrants are required to carry their green card.

    Many times, I’ve been to Mexico, and other countries, and I always carry identification. The only people who do not carry identification, are illegal aliens.

    So the only people against the bill are open border supporters, and ‘profiling’ is the only argument they can use in their criticism of the law.

  4. Some issues I have not seen covered and would appreciate some thoughts and feedback on are: How does the “reasonable suspicion” apply to minors. It’s one thing to have in mind immigrants in general having to provide/carry papers, as odios as that sounds for some. It’s another to imagine my child being swept up at a party without his/her identification papers.
    Additionally, in reading the section of the law devoted to discouraging soliciting work from day-laborers, the law (in part) seems to make it illegal to transport an undocumented person. Would this mean then that a taxi driver would have to ask every customer to provide proof of citizenship?
    Finally, my general take on the law is that it’s bad for police who will get saddled with the duty of being immigration officers instead of keepers of the peace.

If one respects the concept of the rule of law, and the legal, just enforcement of the rule of law ,and if one reads this law, in full, with no private prejudice or agenda, one will come to understand that this law is a necessary first step toward enforcement of laws too long ignored- and not only in Arizona. This law is in place to assure one’s Constitutional rights as a citizen of the United States, or as a legally registered visitor. If one is not in compliance with the terms of this law, then one is in violation of the law. Read the law. Understand it, or seek understanding.

Do any of you realize how damaging it would be to YOUR lives if Mexicans were run out of our country? Housing would cost far more, it would take far longer to build a house, your produce would quadruple in price and there simply wouldn’t be any spoiled white kids willing to take over the demeaning jobs that these immigrants are quietly accepting.

    • Travis, what part of the word “illegal” you do not understand? This law is not against legal immigrants it is against “illegal” immigrants.
      I would prefer to pay double for my grociery then to pay for illegal’s housing,health care and education.I ,as the legal immigrant in this country
      have no rights to free medicare.My taxes help to provide for those who do not support our system.
      By the way did you have a chance to read the full text of the new AZ immigration law? I bet you didn’t.You only know what the the media is telling you.

      I think you miss the point, the law is not against Mexicans. Its against illegal immigrants from any part of the world. If they come to the country legally, there wont be cause for alarm. Don’t forget, as there are many illegals so are there many legal immigrants that will do the jobs if illegal are sent home.

    • Are you suggesting that illegal immigrants are willing to come to the US for sh!t jobs because that’s all they can do; further, are you suggesting that everyone white is rich and spoiled? In case you haven’t noticed, housing prices are falling, construction has all-but stopped, and when strawberries/oranges/avocados etc. were grown in California (and often picked by LEGAL immigrants) they didn’t cost four prices and they weren’t fertilized with human sh!t. Eventually, the cost of all this sh!t will affect you and your tune will change; be it demand for a job you now take for granted (spoiled black, white, Asian, or whomever you are as a US citizen), be it state services no longer available to you (even though you had no choice but to pay for them with your taxes), or be it the sh!t on your strawberries.

      • I have not read all of the bill, and I do not need to. I have no problem with immigrants, as long as they are hear legally. I do have a proplem with illegal immigrants. They are taking jobs from Americans, we are being made to give them free medical care, education, and everything else! I love this country for all that it is, but this is going to far, this bill is probably one of the best bills that I have ever heard of. I think that every state should pass this same bill.

  8. Ricardo, there are plenty of Americans with no papers. People who are homeless can’t get IDs because they have no address. People with mental illness often don’t have any identification.

    And BTW, drivers licenses are not proof of citizenship.

    • Brian, a drivers license cannot be obtained without proof of legal status in the country. So it would acctually be proof of legality at least. So far noone is asking for proof of citizenship.

      As for your first comment you do bring a good point, I wonder what will they do about that? or is there a way to get ID when you are homeless? anyone know?

We are people to i am mexican i was born here in the us and we have feelings we have families lives dreams and hope this disgraceful law is the worst and should be veto just cause were brown doesnt mean anything and geuss how old i am im 14 years old and i think that govener should be disband from possion i love the us and it has meast up laws but this is the worst

    • you’ll have to deal with being a second class citizen Melissa, make sure you have your papers on you at all times. If god didn’t mean for you to have to carry ID on you at all times he would have made you white, honeybunny.

      • Ceri what a mean thing to say to a 14 yr. old! Anyway God doesn’t have anything to do with this Melissa, and if you are so worried just ask your parents to take you to MVD where they get their drivers license and you can get an ID card for a minor, is just like a drivers license and it is just a legal ID and proof of legal status for a minor. Good luck.

    • If you think about it, we are all either immigrants or children of immigrants in the United States. My family came from Ireland. The point of the law is merely to control who comes in and stays in the country.
      By the way, it is hard to forget my first trip to Baja California driving along and seeing an M16 pointed at me. I stopped, showed my papers and they let me go. At least you do not have someone pointing guns at you as you drive down the road!

  10. Shame on the federal government for not safeguarding our borders. Why is it that I need to prove I’m a citizen to get a passport but our Commander and Thief does not need to prove he is a citizen of the United States to be president. All illegals should be deported back to their country of orgin, no more drop the baby citizenship, that was not the intent. Feds build the fence and defned our borders.

      I came to this country legaly.It was long and hard road,but as you said I had patience. I have been in US for 30 years and did’t get 1 cent out of tax payers money .I contributed do the system a lot and I am proud of it.

  11. To all of those who criticize this new, tough law, what would you DO? Not lip service or complaining, what would you DO? Its easy to be critical, not so easy to solve the problem, one that is the charge of the federal government, and Arizona is tired of being overrun and spending millions of dollars caused by this problem. I fail to see why those who are critical seem to not understand what the word illegal in illegal immigration means. Are we not a nation of laws? Do you mean we support and enforce only the laws we like? It doesn’t work that way.

    All of us are talking dreams and hopes and of living in America. We all want that for you, your family, and ANY other person who wishes to live here. Its about doing it legally, nothing else. This is not a witch hunt, seeking to force those who we don’t like out. On the contrary. We legal citizens want anyone who wants to be here the opportunity and ability to be here. JUST LEGALLY. I am a Republican who loves dearly our country, but when we aren’t in control of our borders, it threatens all of us who are here as legal citizens, and history shows that countries who don’t control their borders, don’t remain a country in control of its destiny for very long. We can’t let this go on. Those of us who believe in the rule of law, care too deeply to see our great country on the decline, this being one reason for that.

  13. I’m a 3rd generation American. My grandparents came here from Europe as children. My wife is a first generation American from Asia.

    As I told my daughter and most of her friends last year, we are all blessed by God to be able to live in the greatest country ever known to mankind. We have individual rights, which are given to us by God, not by the Government.

    We are a country of immigrants, and, I hope that we will always attract immigrants here to join this great nation. The 4th Amendment protects us from search and seizure, which was very important to our Founding Fathers.

    Come one, come all but we can’t handle everyone at once. Have patience, all we ask, is that all immigrants go through the legal process completely. I understand it is a long process; however, it is worth the effort. We ask that everyone abide by our laws. Our God asks that we love God and our fellow man. Even God provided us the Ten Commandments to follow.

    I wish USA will adopt Mexican Immigration Law.

I do not agree with you that by “running the Mexicans out of our country” that would raise pricing of anything; in fact, I believe it would be just the opposite. This country did just fine before the flood of illegal immigrants from Mexico arrived, and I am sure we will do fine if and when we can remove them.

    Unfortunately the republicans do not have the balls to really do anything about it and the progressive demarcate see them as voters.

  16. I am an American from California. My family has been here since before there was a United States. I do not want any more illegals coming to my home and taking away jobs and using our social services. This is not a law against brown people, it is a law for Americans. I do not speak Spanish and I do not want to learn. Arizona is doing the right thing. I do not mind if a police officer asks me for my ID, i have it and will hand it over willingly.

  17. I agree with this new Arizona bill. They are now terrorists committing crimes, stealing American children and holding them hostage; they’re killing and threatening to kill Americans if they even surmise that they are picking up their cell phones to call border control for their drug cartel ling. Of course “something” had to be done. Allowing the police to act on laws that were “always” supposed to be exercised is “not” a bad thing and it has “nothing” to do with racism at all. Also, I am just wondering why they do not build a Real Wall and a Real Fence. Such as a brick or concrete very tall wall should be built, along with a tall barbed wire fence on top of the tall brick wall. The tall barged wire fence on top of the brick wall (the fence should have electrical shocks for whoever touches it). That is what they do so prisoners cannot escape. It would help a lot. It would even create new jobs for “American” Construction and Masonry construction workers.

The laws are meant to protect the nation’s sovereignty and numerous protections for tax paying citizens. All countries have immigration laws and enforce them, especially Mexico. The US does not enforce its own immigration laws, for mysterious underlying reasons. We, the people of the US should demand our government follow its own laws. The laws are there for very good reasons. People keep confusing racism with immigration laws, raciscm has nothing to do with it. People say the immigrants are taking jobs Americans don’t want.   19. I have just read the bill. There is noting in this bill that really isn’t reasonable.

    Stopping on the roadway to hire a worker. Get off the road and don’t block traffic. It’s dangerous.

    Not hiring undocuminted workers. What is wrong with that.

    Not taking government money while having undocumented workers.

    I have seen nothing about “Yov must have your papers” (in german) or stopping cars at will.

  20. Fellow ‘Legal’ Citizens…

    Having been born and raised in this country, I have long since learned to carry my ID with me at ALL TIMES, when I’m away from home, even if it’s means only going to the grocery !!! As such, it’s no more of a hassle for me to carry my ID with me, than it is to carry $$$ with me to pay my way.

    Also, being a 10 Year veteran of a major cities Police Force in Central Ohio, I KNOW PRECISELY where the brunt of the responsibility for this new laws implementation will be, precisely on the head of each and every Law Enforcement Officer and / or Official. It will be to each and every one of them, to see to it both Personally as well as Professionally, to GUARANTEE that the very real concern of ‘Illegal’ profiling, DOES NOT become an issue, based on whatever criteria.

    Lets be serious, shall we ??? We TRUST our duly appointed Law Enforcement Officers and / or Officials, to protect us every moment of every day of our lives in this Nation. When something horrible happens, they’re the ones that we call first, and they’re the ones who are usually the first to arrive, to help you in any way that they can, no matter the time or place or problem, even at the cost of their very lives…

    My fellow Citizens, let’s face it, we own them, we owe them all, everything we have, for the world we live our lives in, day in and day out…

    So, with respect to the newly signed Arizona Immigration Law, I’ll say this… If I lived anywhere near the border in ANY border state and were experiencing the sort of literally murderous behavior that my fellow citizens are in Arizona, I would be 110% in favor of the new law, and would do whatever I could to help implement it, most importantly, PROPERLY !!!!

  23. Illegals from Mexico,Cuba, Asia all need to be deported from this Country.They also need to deport the children who were born here in Amrica! No one can see the trees from the forest… Illegal Immigration is destroying our country in many ways..I have had many friends from Europe who had to return to there country when there Visas were expired and had to wait 3 Months to return and if they did not return they were deported! If they tried to get a green card they went through hell and a huge costs and time like up to five years and that is just to get a green card.. But if your skin is Brown, Yellow, you can just, swim, smuggle, or walk on over into America and that is ok?? EXCUSE ME! Is that NOT DISCRIMINATION against White Europeons?? THIS nothing but a bunch of politicians in the White house are SCARED TO DEATH to lose the Hispanic Votes. Everything today is in SPANISH AND ENGLISH!! WHAT THE HELL IS THIS!   25. There are many immigrants that contribute to this grea country. A lot of them pay taxes and live in harmony. Immigrants pay property taxes, income taxes (ask the IRS) taxes on products. Maybe they have the right to use services as everyone else. Being an immigrant doesn’t mean that they are killers or that they sell drugs. In reality most of the people that come to the US is because they want a better. Isn’t that what people have been doing since this country started to grow?
    Maybe some people are right some immigrants are bad, look at the Europens that destroyed the NATIVE AMERICANS. They took away their culture, language and beliefs. They invaded everything and they are afraid that Latinos are going to do the same thing. HOW SAD!!!!!!!!! 🙁 I think that everyone should have the right to be here only if they are going to help the country.

  26. i think that all this would be resolved if the US passed on an immigration reform and make sure they only give “papers” to those who are here to work and spit out the criminals and everyone with warrants or any criminal history and let the rest of us who are here to work and make a better living, do it legaly.
